Sadly though the climb in question could easily have been done in complete safety even without an installed safety system and with virtually no loss of time or significant increase in cost. Simply while climber A rests he top belays climber B and while climber B rests he bottom belays climber A. Only needs a relatively short rope, the top climber loops the rope over the ladder rungs as he goes, if there's no ladder rungs then all that's needed is a simple sling and carabiner. Like the US there is no REQUIREMENT in the UK for permanently installed systems (I've climbed many masts without them) but many companies fit them to avoid liability issues.

There is no explicit rule that says you need to fit a permanent fall arrest system (and there's more than one reason not to- not only does it cost money, but it might encourage idiots.) However there is a general duty of care under the Health and Safety at work etc act which requires employers to reduce risk "as far as is reasonably practicable". As Martin points out, there's a perfectly simple system for doing this better. Not doing so would constitute "failure to provide a safe system of work" and (I think) is a breach of the act. It's probably also a breach of the work at height regulations.

OK, spot the bloke who works for the health and safey people.
