Wow, this is all ridiculous.

I think if i ever start selling stuff on eBay, i will put this as the info on each sell:

"If you claim the item is not as described and cheat me out of my money, i *will* find you".

That way, i get no buyers, i get into trouble with eBay, and kill my reputation all while not getting cheated out of my money! What a great idea. I probably would warn buyers that i am not going to play games, though.

I guess you could get a lawyer if you lost something unfairly from this (as well as buyers being cheated), in which case surely eBay would change their policy about people claiming the item is no good. But they would have to rule out returns to fix that, but i guess you could work something out via E-mail if you decide to trust someone enough to work with them. Never trust the internet...

Not going to help with ebay though.
If someone pays you with you with paypal, they hold the funds for 21 days until A) the buyer leaves you positive feedback, or B) proof of delivery is sent to ebay (i.e. tracking number)

The 21 days thing protects no one against anything.
Its just another way for paypal to make money as they can keep your funds for 21 days to gain interest. multiply this by a million and they're making millions!

So get this...They idio child sent the item to the wrong address. Ebay gave him my return address and delivery confirmaion shows he mailed it somewhere else! The customer service rep looked at this and told me I was no longer responsible for the item or funds and that the BUYER is reponsible! HA HA!

So looks like my prayers were answered! How bout that?! The idiot buyer continues his trend to spank himself in the end. I believe this is being an asshat?

Oh yea, and about sellers terms...Ebay says they can override (and will) the sellers terms for any reason. They also said that "no returns" is not a true option. They WILL overrride that 100% of the time.

Lets cross fingers that this ends the way that the customer rep said it will...

That's a pretty harsh policy toward sellers overall. From what I understood there was at least some way to protect yourself as a seller seeing how ebay's stance is "you are establishing a contract between yourself and the buyer". If they can void your contract at will, then why even mention it, that's just playing make-believe with legal words.

Ebay is going to have to change their intervention policy someday or they're going to get shut down in a big lawsuit for infringment over something stupid.

Im sure ebay has the brightest minds wokring for them in the "bull sh*t" dept.

Im just glad that they seem to have sided with me, albeit because the buyer is a total screw up...I am still on edge that he might find away to shift this back to me even though the customer service rep said I was no longer liable for the refund. To top it off, the little bastard left me my FIRST negative...

Nope, got told today that ebay doesnt get involved in feedback, even if it is unfair and untrue. The only way is if I try leaving the buyer a comment that isnt in their favor, or if I try to post his private information. Aside from that, id need a court order. tongue

Yes, I am NOT allowed to say anthing but positive things about the buyer. This way, the buyer can extort things from the seller. All this is so the buyer has a better ebay experience.

What BULLSH*T?

Lesson to be learned here: Be able to look past a few negatives incase the seller IS honest and has simply suffered from an asshat buyer.

Oh well, at least ebay told me they WILL be investigating this buyer since THEY had to take the loss. (They instantly refunded him once DC showed item delivered, and then had to let me off the hool since he sent it to the wrong place)

Can't you respond to feedback that's posted? If you can, you can say what the buyer did so when others look at what the negative was, they'll just see that person was being a butt.

When I DID buy from eBay, I didn't pay attention to anything like 1-5 negatives (or even a 95%) as the % of society that is not satisfied with anything is higher than that! You can get a negative for what someone considers "late". That's ridiculous. I once waited for a longer period than necessary and when I contacted the guy, he told me he had some medical issues a few days before. Who am I not to believe that? And what type of jerk wouldn't cut someone some slack for being in hospital???

What I DID pay attention to was the pictures that appeared to be designed to disguise the product. There are some of those....The worst burn I ever had from eBay was a picture of some components that were too far to read what was there. When I got the product, they were unmarked and were junk (unmarked TO-220's selling as Fairchilds MJE19003 and were most likely 3 cent diodes or blown FETS). It's not the $ that did it at all (of course); it's the hassle.

The other thing is the person who scams a return with a box of dirt. - My Lord, don't people have better things to do then cheat someone out of a few dollars? I've heard about this more than a few times. With no protection for the seller; who would want to sell high-end items in that risky of a place?
