I've been on the other end, I owned a domain name & a company used Nominet to get the domain name from me... it turned out that the company & trade marks had been registered after I had bought the domain name - so my claim of reverse hijacking was upheld :)
For .au domain names, start with auda, The Australian Domain Name Administrator - They have an arbitration service for cases of name hijacking -
For other TLD names start with Icann - their domain name dispute resolution policies can be found here;

1.) There are domain scams where you are contacted with a "serious" threat of legal action unless you comply. Use anonymous WHOIS registration and it will cut down on this BS spam.
2.) To claim a domain is a lengthy legal process. Essentially you can sue them for trademark infringement if your company was around before their company existed and you can prove they are not (nor plan on) making legitimate use of the domain (squatting is technically a violation, simply show the other domains they own with the identical content.) It is cheap to register your business and pay the copyright upkeep fees in advance. The next step requires a US court order to ICANN if their current register does not comply with the order.
3.) You probably guessed right in that even Oreo, CocaCola, and numerous other companies spend much more than $400 to claim trademark ownership. Pay by registered check from a single use bank checking account limited to $500 (close the account once the transfer is locked AND HOSTED with your domain registrar.)
